I understand what you mean, but it doesn't look like there was a lot of space for the judge to stand in the first place. Plus, they might not have noticed how close they were.
If he had had to ask the judge to move while he was solving, I would agree, but as it was before the solve, I don't think he should be given another try.

Well the inspection hadn't finished yet. His hands were on the timer. The competitor should only be thinking about his or her first moves, not whether or not he has enough room. Just sayin'

Well, I don't think I should be given another try, but I don't think asking for more space is a problem either. I just asked for more space so that I can solve more comfortably. Also, I got a bad time on that just because the scramble was less lucky.
